Please contact us if Kohn Law Firm is suing you or trying to collect money from you, or has attempted to do so within the last year. They represent a number of common collection plaintiffs, including Midland Credit Management.
We regularly defend cases that they bring and can protect your interests. We are also investigating whether they are complying with the Fair Debt Collection Practices Act. For example, they may leave telephone messages that do not comply with the requirements of the FDCPA and file suit on debts that are barred by the statute of limitations.
Our attorneys have a total of more than 100 years experience handling consumer lawsuits, including both lawsuits by consumers and lawsuits against consumers. One of them wrote the book on defending collection lawsuits. D. Edelman et al., Collection Litigation: Representing the Debtor (Illinois Institute for Continuing Legal Education 2008, 2011, 2014, 2019, 2022 editions), as well as the chapters in Illinois Institute for Continuing Legal Education publications on the Truth in Lending Act, Fair Debt Collection Practices Act, Telephone Consumer Protection Act, and mortgage-related claims.
If you are being sued, it is important that you do not default (fail to appear in court), and that you vacate any defaults that exist right away. Debt buyers and debt collectors count on your defaulting in order to win. Once they have a default judgment, they will try to garnish your wages and bank accounts. Make sure to call us for a free consultation as soon as possible before your court date, or if a default has already been entered, right away.
We have defended consumers in Cook, DuPage, Kane, Will, McHenry, Kendall, Grundy, Lake, DeKalb, Kankakee, Carroll, Clinton, Winnebago, Bureau, LaSalle, Boone, McDonough, Rock Island, Knox and Whiteside Counties, Illinois.
We do not charge for evaluating cases. If we conclude that we can be of assistance to you, we charge modest fees for defending collection cases.
