Illinois Gov. J.B. Pritzker has again extended Executive Order 2020-25, which suspends the issuance of garnishment, wage deductions and post-judgment citations to discover assets. Per the extension, these restrictions will now remain in effect through April 30, 2021. Executive Order 2020-25 suspended Sections 5/12-705 and 805 of the Illinois Code of Civil Procedure (735 ILCS 5/12-705 and 735 ILCS 5/12-805), which permit service of garnishment summonses and wage-deduction summonses, respectively, as well as 735 ILCS 5/2-1402 of the Illinois Code of Civil Procedure (735 ILCS 5/2-1402), which permits citations to discover assets on a consumer debtor or consumer garnishee. Per the terms of Executive Order 2020-25, the suspension of these provisions of the ILCS do not apply to domestic support obligations and “shall not be construed as relieving a debtor of any liability.”
