Please contact us if you (or a relative) are in a nursing home or assisted living facility, receiving Medicaid, and your stimulus check has been taken by the home / facility.
Nursing homes have no claim to their residents' stimulus checks. The checks are considered tax credits under the CARES Act, which is providing economic relief to people and businesses. Those tax credits don't count as "resources" for federal benefit programs like Medicaid, so that neither the government nor a nursing home can claim them or ask the resident to sign them over to them.
The Federal Trade Commission and several state Attorneys General have reported that nursing homes are taking the checks.
