Question: I have a judgment against me. The creditor froze my bank account. What can I do to stop frozen account?
Answer: You have a 4,000 “wildcard” exemption per person (735 ILCS 5/12-1001) that can be applied to a bank account. There are also exemptions based on the source of funds, such as Social Security.
File a motion with the court to have $4,000 per person released. The bank is supposed to claim exemptions based on the source of funds, such as Social Security; if they have not, file a motion for that also.
